Terms of Sale

These Terms of Sale govern your purchase of products from 21 Ananta Farmers Market ("we", "us", "our") through this website. By placing an order, you agree to these terms. Please read them together with our Privacy Policy, Returns & Refunds Policy and Shipping & Delivery Policy.

1. About us

21 Ananta Farmers Market is an Australian business selling fresh fruit, vegetables and related products. Our ABN is currently Application Pending and will be published here once registered.

2. Orders

• An order is an offer to buy. Your order is accepted when we send you an order confirmation email.
• We may decline or cancel an order — for example if a product is unavailable, there is a pricing error, or we cannot deliver to your area. If we cancel, we will refund any payment already made.
• Because we sell fresh produce, exact weights and sizes can vary slightly. We pick the best available and aim to match your order as closely as possible.

3. Prices and GST

• All prices are in Australian dollars (AUD).
• Basic fresh fruit and vegetables are GST-free under the A New Tax System (Goods and Services Tax) Act 1999. Where a product is taxable, the price shown includes GST and this is itemised on your tax invoice.
• Delivery fees (if any) are shown at checkout before you pay.
• We may change prices at any time, but changes won't affect orders we've already accepted.

4. Payment

Secure online payment is being finalised. Until it is live, we will contact you after you place your order to arrange payment (for example by bank transfer or card). Your order and produce are reserved while payment is arranged. We will only fulfil and dispatch your order once payment is received or otherwise agreed.

5. Delivery and pickup

Delivery and pickup are covered by our Shipping & Delivery Policy. Risk in the products passes to you on delivery or collection.

6. Your consumer rights

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. See our Returns & Refunds Policy for details and how to make a claim.

7. Food safety and allergens

We handle fresh produce in line with Australian food safety standards (see our Food Safety page). Produce may be grown or packed in facilities that also handle allergens. Always wash fresh produce before eating. If you have specific allergy or dietary needs, contact us before ordering.

8. Cancellations and changes

If you need to change or cancel an order, contact us as soon as possible. Because produce is picked to order, we may not be able to change an order once it has been packed or dispatched.

9. Your account

You are responsible for keeping your account login secure. Let us know immediately if you suspect any unauthorised use.

10. Liability

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, our liability for any product is limited to replacing the product or refunding its price.

11. Governing law

These terms are governed by the laws of Australia and the state in which we operate. Disputes are subject to the jurisdiction of the courts of that state.
